These Terms and Conditions apply to online reservations for cars, scooters, and ATVs (each a “Vehicle”) made with Top Rentals Zante P.C. (“Top Rentals”, “Company”, “we”, “us”, “our”) by the person making the reservation and signing the Contract (“Renter”, “you”, “your”). They apply to online bookings made directly with Top Rentals and should be read together with the signed Contract and its Terms and Conditions provided at vehicle collection, which contain the full rental terms. If there is any inconsistency between these online Terms and the signed Contract or its Terms and Conditions, the signed Contract and its Terms and Conditions shall prevail.
1. Driver Qualifications & Requirements
1.1 Age Requirements
The minimum age for all drivers is 18. The maximum age is 79.
Minimum age by vehicle type and category:
- Cars:
- 19 for categories A2, B2, Automatic A2
- 21 for categories A1, B1, Automatic A1, Automatic B1, Cabrio, 4×4 Open Top, 7 Seater
- 25 for categories D, SUV Compact, SUV Automatic, SUV, Luxury, 9 Seater
- ATVs: 18.
- Scooters: 18.
The age of each driver will be checked when the Vehicle is collected. If a driver does not meet the applicable age requirement, the reservation will be invalid, the rental will be refused, and no refund will be given.
1.2 Driver’s License
1.2.1 Accepted Licenses
- EU driving licenses;
- non-EU driving licenses written in the Latin alphabet;
- non-EU driving licenses written in a non-Latin alphabet only if accompanied by a valid International Driving Permit (IDP).
Digital copies, temporary licenses, learner permits, and expired licenses are not accepted.
1.2.2 Minimum License Holding Period
- Cars: each driver must hold a valid driving license for at least one (1) year;
- Scooters and ATVs: no minimum holding period is required.
1.3 Additional Drivers
Any additional driver must meet the same age and license requirements as the main driver.
All drivers must be listed in the Contract. If a person not listed in the Contract drives the Vehicle, the Renter will be fully responsible for any resulting damage, loss, or cost, and any applicable protection may not apply.
2. Booking, Modifications & Cancellations
2.1 Vehicle Selection
All bookings are made by vehicle category and not by specific model.
If the selected model is not available, the Company may provide:
- an equivalent Vehicle in the same category; or
- a Vehicle in a higher category at no extra cost.
Any reference to a specific make, model, brand, or feature is for guidance only and is not guaranteed.
2.2 Cancellation Policy
Cancellation requests must be sent by email and take effect when received by the Company.
- Cancellations more than 48 hours before pick-up: full refund.
- Cancellations less than 48 hours before pick-up: non-refundable.
- No-show: non-refundable.
- Delay of more than 1 hour without prior notice: may be treated as a no-show.
Once the Contract has been signed and the Vehicle has been delivered, no refund will be given for early return or unused rental days.
2.3 Reservation Modifications
Booking modifications are subject to availability and must be requested in advance. A modification requested less than 48 hours before pick-up may be treated as a cancellation.
2.4 Flight Delays
No additional charge applies for flight delays during business hours (8:00-21:00). Flight delays outside business hours may be subject to an out-of-hours charge.
3. Delivery, Collection & Operational Use
3.1 Delivery & Collection
Delivery and collection during business hours are free of charge. Delivery or collection outside business hours may be subject to an additional charge.
3.2 Rental Extensions & Late Returns
Rental extensions require prior approval and are subject to availability.
A grace period of 30 minutes applies to late returns.
If the delay exceeds the grace period:
- a late fee may apply; and
- delays exceeding 2 hours may be charged as an additional rental day.
3.3 Mileage
Unlimited mileage applies only within Zakynthos and, where separately approved by the Company, Kefalonia, unless otherwise stated in the Contract.
3.4 Ferry & Cross-Border Travel
3.4.1 General Rules
The Vehicle must not be transported by ferry or taken outside Zakynthos without the Company’s prior approval.
Cross-border travel outside Greece is strictly prohibited.
Any ferry transport, removal of the Vehicle from Zakynthos, or cross-border use without approval may result in loss of applicable protection, and the Renter will remain fully responsible for any resulting damage, loss, or related cost.
Any damage occurring during ferry transport is excluded from any insurance or protection package.
3.4.2 Travel to Kefalonia
Travel to Kefalonia is allowed only with the Company’s prior approval and payment of the applicable one-time island exit fee.
3.4.3 Travel to Other Approved Off-Island Locations
Travel outside Zakynthos to any other approved location is allowed only with the Company’s prior approval and payment of the applicable one-time island exit fee. Additional daily charges and mileage limitations may apply.
3.5 Fuel Policy
Vehicles must be returned with the same fuel level as at pick-up. If the Vehicle is returned with less fuel, the Renter will be charged for the missing fuel together with the applicable refuelling service fee. No refund or credit will be given for excess fuel.
3.6 GPS & Location Sharing
Vehicles may be equipped with GPS or other location tracking systems for security, theft prevention, vehicle recovery, fleet management, and related operational purposes. Any personal data collected through such systems will be processed in accordance with applicable data protection laws.
4. Insurance Packages & Protection
4.1 General Principle
The level of protection available to the Renter depends on:
- the Vehicle type;
- the selected protection package; and
- compliance with the Contract and these Terms.
All protection packages, waivers, and insurance-related benefits are subject to the exclusions, responsibilities, and reporting obligations set out in Sections 5 and 6.
4.2 Car Protection Packages
4.2.1 Basic Package
The Basic Package is included in all car rentals and includes:
- Third Party Liability Insurance (TPI);
- Personal Accident Insurance (PAI);
- 24/7 roadside and telephone assistance.
No damage waiver applies under this package. The Renter remains fully responsible for any loss of or damage to the rented Vehicle, except to the extent covered by mandatory third-party insurance.
4.2.2 Standard Package
The Standard Package includes:
- Collision Damage Waiver (CDW);
- Theft Protection;
- Fire Protection.
Under this package, the Renter’s financial liability for covered damage is reduced to the applicable excess shown in the Contract. Depending on the vehicle category, the excess ranges from €600 to €1,800.
4.2.3 Premium Package
The Premium Package includes:
- Full Damage Waiver (FDW);
- Theft Protection;
- Fire Protection.
Under this package, the Renter’s financial liability for covered damage is reduced to the applicable excess of €0.
Premium also extends protection beyond standard bodywork coverage to additional parts specified in the Contract, including wheels, tires, glass, and mirrors.
4.3 Scooter & ATV Protection Packages
4.3.1 Basic Package
The Basic Package is included in all scooter and ATV rentals and includes:
- Third Party Liability Insurance (TPI);
- Personal Accident Insurance (PAI);
- 24/7 roadside and telephone assistance.
No damage waiver applies under this package. The Renter remains fully responsible for any loss of or damage to the rented Vehicle, except to the extent covered by mandatory third-party insurance.
4.3.2 Standard Package
The Standard Package includes:
- Collision Damage Waiver (CDW).
Under this package, the Renter’s financial liability for covered damage is reduced to the applicable excess shown in the Contract. Depending on the vehicle category, the excess ranges from €600 to €2,450.
4.3.3 Premium Package
The Premium Package includes:
- Super Collision Damage Waiver (SCDW).
Under this package, the Renter’s financial liability for covered damage is reduced to the applicable excess shown in the Contract. Depending on the Vehicle category, the excess ranges from €150 to €600.
4.4 Damage Waivers
4.4.1 Collision Damage Waiver (CDW) – Cars, Scooters, and ATVs
CDW reduces the Renter’s financial liability for covered damage up to the applicable excess shown in the Contract.
- For cars, CDW applies to bodywork damage only, meaning the external painted body panels of the Vehicle.
- For scooters and ATVs, CDW applies to the external fairings and body panels.
CDW does not cover, unless expressly stated otherwise:
- wheels, tires, glass, mirrors, or lights;
- mechanical parts, engine components, clutch, transmission, or suspension;
- underside, roof, or interior;
- accessories, keys, locks, or personal belongings.
4.4.2 Full Damage Waiver (FDW) – Cars Only
FDW applies only to cars and further reduces the Renter’s financial liability for covered damage.
FDW includes the same bodywork protection available under CDW and, in addition, extends protection to wheels, tires, glass, and mirrors. For covered damage, the applicable excess is reduced to €0, subject to the Contract and these Terms.
4.4.3 Super Collision Damage Waiver (SCDW) – Scooters and ATVs Only
SCDW applies only to scooters and ATVs and further reduces the Renter’s financial liability for covered damage.
SCDW applies to the same categories of covered damage as CDW, but with a reduced excess.
4.5 Additional Insurance Protections
4.5.1 Third Party Liability Insurance (TPI)
TPI is included in all rentals. It covers the legal liability of the driver for bodily injury or property damage caused to third parties, up to the limits required by applicable Greek law.
4.5.2 Personal Accident Insurance (PAI)
PAI is included in all rentals. It provides limited cover for bodily injury sustained by the driver and passengers during the rental period, subject to the applicable policy terms and limits.
4.5.3 Theft Protection
For cars, Theft Protection is included in the Standard and Premium packages, subject to the applicable excess shown in the Contract and these Terms. In the event of theft or attempted theft, the Renter must immediately notify the Company and the police and provide the required documents and keys.
4.5.4 Fire Protection
For cars, Fire Protection is included in the Standard and Premium packages, subject to the applicable excess shown in the Contract and these Terms. Any fire incident must be reported immediately to the Company and, where required, to the relevant authorities.
5. Renter Responsibilities, Prohibited Uses & Charges
5.1 General Responsibility
The Renter must use the Vehicle carefully, lawfully, and in accordance with the Contract, these Terms, and all applicable traffic laws and regulations. The Renter is responsible for the Vehicle during the rental period and remains liable for any loss, damage, cost, fine, claim, or expense arising from breach of these Terms, prohibited use, negligence, misuse, or unauthorized use.
5.2 Prohibited Use
The following uses of the Vehicle are strictly prohibited:
- use by any driver not listed in the Contract;
- driving under the influence of alcohol, drugs, or any substance affecting driving ability;
- use for any illegal purpose;
- use for racing, speed testing, rallying, competition, or similar activity;
- use for towing, pushing, or carrying hazardous, dangerous, or prohibited materials;
- use beyond the permitted passenger or load capacity of the Vehicle;
- use after any dashboard warning, mechanical warning, overheating warning, puncture, or other sign that the Vehicle should be stopped or checked;
- use on roads, routes, or surfaces unsuitable for the Vehicle;
- use off-road or on unpaved, unsealed, rough, rocky, flooded, beach, forest, mountain, agricultural, or dirt roads not intended for normal public circulation;
- ferry transport or removal of the Vehicle from Zakynthos without the Company’s prior approval;
- any cross-border use outside Greece.
Any such use may void all insurance and protection coverage and may make the Renter fully liable.
5.3 Insurance and Protection Exclusions
Without limiting any other exclusion in these Terms, insurance and protection coverage will not apply, or may be reduced or withdrawn, in any of the following cases:
- failure to report an accident, theft, damage, or incident promptly and correctly;
- failure to notify the police or other authorities where required;
- failure to provide accurate information, documents, keys, or evidence requested by the Company or insurer;
- reckless, dangerous, abusive, or intentional misuse of the Vehicle;
- clutch damage caused by improper use;
- damage caused by overloading the Vehicle;
- damage caused by wrong fuel;
- damage resulting from continued driving after a warning light, mechanical issue, overheating, puncture, or visible problem;
- damage caused by use on prohibited roads or surfaces;
- damage caused during ferry transport;
- damage to the underside, roof, or interior of the Vehicle;
- damage to keys, documents, accessories, child seats, or removable equipment;
- stains, burns, tears, odors, or other interior damage caused during the rental.
In all such cases, the Renter may be charged the full cost of repair, replacement, loss, recovery, transport, downtime, administrative handling, and any other related expense
5.4 Specific Misuse — Scooters and ATVs
No more than two persons may ride a scooter or ATV. If this rule is breached, insurance or protection may no longer apply, and the Renter may be fully responsible for any resulting damage, loss, or cost. The Company may also charge a penalty of €200, without limiting its right to recover any higher actual loss or damage.
5.5 Traffic Fines and Administrative Charges
The Renter is responsible for all traffic fines, parking penalties, toll violations, and other charges arising during the rental period. If the Company has to handle or process any such fine or penalty, an administrative handling fee may also apply.
5.6 Smoking and Cleaning Charges
Smoking is strictly prohibited in all Vehicles. If there is evidence of smoking inside the Vehicle, a cleaning fee of €80 may be charged. If the Vehicle is returned excessively dirty, sandy, muddy, stained, or with strong odors or pet hair, a cleaning fee of €50 may apply.
5.7 Child Seats
Child seats are available on request as an optional extra.
The Company may assist with placement of a child seat, but the Renter remains fully responsible for checking that it is suitable, correctly installed, and securely fastened before use.
6.Accidents & Emergency Procedures
6.1 Reporting of Accidents, Damage, Theft, and Other Incidents
In the event of an accident, collision, theft, fire, damage, mechanical issue, or warning-light event, the Renter must notify the Company immediately and follow the Company’s instructions. Where required, the Renter must also contact the police or other competent authority and obtain an official report. Failure to comply with these reporting obligations may affect the availability of any applicable protection.
6.2 24/7 Roadside and Telephone Assistance
24/7 roadside and telephone assistance is included for accidents and genuine mechanical breakdowns not caused by the Renter’s fault. If assistance is required because of negligence, misuse, or improper operation of the Vehicle, the Company may charge a service fee together with any third-party cost.
6.3 Replacement Vehicle
If the Vehicle becomes unusable due to mechanical breakdown or an accident, the Company will make reasonable efforts to provide a replacement vehicle, subject to availability and compliance with these Terms.
7. Financial Terms & Penalties
7.1 Taxes & VAT
All rental rates include VAT and any applicable local taxes.
7.2 Fixed Charges for Loss or Negligence
The following fixed charges apply unless the actual loss or replacement cost is higher:
- lost car key: €150 for a standard key and €300 for a special key;
- lost scooter or ATV key: €50;
- lost baby or infant seat: €100;
- lost booster seat: €60;
- lost plastic rim cover: €100 per item.
These charges are separate from and in addition to any rental charge, excess amount, recovery cost, administrative fee, repair cost, or other amount due under the Contract or these Terms.
7.3 Vehicle Return Condition
The Vehicle must be returned in the same condition in which it was received, excluding normal wear resulting from proper and lawful use. If the Vehicle is returned with damage, excessive wear, missing parts, missing accessories, or abnormal deterioration, the Renter may be charged the reasonable related cost, subject to the selected protection package and these Terms.
7.4 Card Pre-Authorization and Payment
No card pre-authorization is required unless expressly stated on the first page of the Contract. Where applicable under the Contract, the Company may pre-authorize or charge the payment card provided for any amount properly due under the Contract or these Terms.
8. Legal Rights, Termination & Jurisdiction
8.1 Termination by the Company
The Company may immediately terminate the rental, without refund, if the Renter breaches these Terms, including in any of the cases described in Section 5. In such cases, the Renter remains fully responsible for all resulting fines, penalties, losses, damages, and costs, and the Company may take any reasonable and lawful measure necessary to locate, secure, recover, or protect the Vehicle.
8.2 Updates to These Terms
The Company may update or modify these online Terms at any time before the Contract is signed. The version in force at the time of booking will apply to the online reservation, but the signed Contract and its Terms will govern the rental itself.
8.3 Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of Greece. Any dispute arising out of or in connection with these Terms, the Contract, or the rental of the Vehicle shall be subject to the jurisdiction of the competent courts of Greece.
